7. Returns

Because of the customized and perishable nature of the products we sell, our ability to accept returns is limited. 

If you need to return an item, please contact our Customer Service Department for instructions on how to return items.   If you do not contact our Customer Service Department in advance of returning an item, we may not be able to accept your return or issue a refund.  For safety and health reasons, food and food-related items are not returnable.  For some items there is a restocking fee.  We can provide more information when you call us.  The cost to ship an item to you, or for you to return it to us, is not refundable.  Refunds can only be issued to the same method of payment used to purchase the order.   Credit card refunds must be made on the same credit card that was used to purchase the order.  Your check to us must clear before we can issue a refund to you.

8.  Pricing and Minimum Order Quantities
We do our best to keep our prices and Minimum Order Quantities (MOQ) synchronized with those of our vendors.  Occasionally there may be a delay between a vendor price or quantity adjustment and the update to our website.  We will notify you before we finalize your order if a Price or Minimum Order Quantity has changed.  We make every attempt to honor the prices and quantities listed on our website.   The Minimum Order Quantity for each of our products may be lower than what you see listed, because of deals we can negotiate with our vendors.  If you need less than the posted Minimum Order Quantity, let us know and we’ll work with our vendors to try to meet your needs.   We can also suggest similar products that may meet your needs.

9. Sale Price Rules
We occasionally run sales on products.  Sale prices are only valid during the published time and may not be applied to previous orders.   Sale prices are not honored after a sale has ended.  If you would like more information on sales and other promotions, we suggest that you sign up for our monthly newsletter that outlines the coming sales and promotions.  If we do not provide an expiration date along with a posted sale, then we reserve the right to end the sale at any time at our discretion.

10. When will I receive my Order?
We are not responsible for shipping delays that are a result of credit card/billing problems, product availability delays, or order changes made after the order has been placed.  If you order UPS Ground delivery service, please use the tracking number provided to you to determine when your order will arrive. 

IMPORTANT EXCEPTIONS: Many package carriers do  not pick up or deliver orders on Saturday, Sunday, or major holidays. Days tha tcarriers are  not picking up or delivering are NOT considered shipping days. When counting up your shipping days, consider this important information.

*We are not responsible for package carrier’s performance. Once a package leaves our facility, it is out of our hands. If you need to file a claim for a package that was lost during shipping, please contact our customer service department, and we will file the claim, on your behalf. Please see your package carrier’s  website for their shipping policies.

11. Privacy

You agree that you have read and understand the terms of our Privacy Policy, which can be accessed using the Privacy Policy link on our website.

12. Use of our website

You understand that our website site cannot and does not guarantee that the Sites will be free of infection from viruses or other computer infections that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. You are responsible for implementing sufficient procedures (anti-virus software, etc.) and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

13. Indemnification

You agree to indemnify, defend and hold our company and its affiliates, officers, directors, employees, attorneys, and agents harmless from and against any and all claims, demands, actions, costs, liabilities, losses and damages of any kind (including actual attorneys' fees) resulting from (i) your use, misuse or abuse of our Services or Site, (ii) your use of products or services provided via phone, fax, or through the Site, or (iii) your breach of any provision of this Agreement. You will cooperate as fully as reasonably required in Site's defense of any claim. Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without the written consent of us.

14. Intellectual Property

The contents of our materials and our Site, such as text, graphics, logos, audio clips, video, photographs, software, and other information (the "Content") is the property of the site and/or its affiliates or partners, and is protected by federal and international copyright and trademark laws, or other proprietary rights. These rights are protected in all forms, media and technologies existing now or hereinafter developed. You may print and download portions of the Content from the different areas of the Site solely for your personal non-commercial use. No portion of the Content may be reprinted, republished, modified, or distributed in any form without the express written permission of us.

You may not, and this Agreement does not give you permission to, reproduce, reverse engineer, decompile, disassemble, modify, transmit, sell, distribute, license or create derivative works with respect to the Site. Certain Content may be licensed from third parties and all such third party Content and all intellectual property rights related to the third party Content belong to the respective third parties. You may not remove, alter or modify any copyright, trademark or other intellectual property or proprietary notice or legend contained on the Site or the Content. Any rights not expressly granted by this Agreement or any applicable end-user license agreements are reserved by us.

Nothing contained herein shall be construed as conferring by implication, estoppel or otherwise any license or right under any patent or trademark of our company or any third party. Except as expressly provided above, nothing contained herein shall be construed as conferring any license or rights under any Company copyright.

15. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL WE OR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING THE SITE OR PROVIDING PRODUCTS OR SERVICES THROUGH THE SITE OR VIA PHONE OR FAX ORDER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBLITY OF SUCH DAMAGES) THAT RESULT FROM (I) THE USE OF OR INABILITY TO USE THE SITE (II) THE COST OF PROCUREMENT OF SUBSTITUTE MERCHANDISE AND SERVICES RESULTING FROM ANY MERCHANDISE, DATA, CONTENT OR SERVICES PURCHASED OR OBTAINED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SITE; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS, WARRANTIES, GUARANTEES OR CONDUCT OF COMPANY OR ANY THIRD PARTY ON THE SITE, INCLUDING BUT NOT LIMITED TO STATEMENTS ABOUT THE USE OR FUNCTIONALITY OF ANY MERCHANDISE PURCHASED THROUGH THE SITE; OR (V) ANY OTHER MATTER RELATING TO THE SITE.

YOU HEREBY ACKNOWLEDGE THAT THIS PARAGRAPH SHALL APPLY TO ALL CONTENT, MERCHANDISE, AND SERVICES AVAILABLE THROUGH THE SITE. IN NO EVENT SHALL COMPANIES TOTAL CUMMULATIVE LIABILITY UNDER THESE TERMS EXCEED THE LESSER AMOUNT OF ANY FEES PAID, IF ANY TO SLMS FOR THE USE OF THE SITE BY YOU OR $1.00. BECAUSE SOME STATES MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES LIABILITY IS LIMITED TO THE LEAST AMOUNT PERMITTED BY LAW. THE LIMITATIONS OF LIABILITY PROVIDED IN THIS AGREEMENT INURE TO THE BENEFIT OF SLMS, OUR AFFILIATES, AND TO ALL OF OUR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, ATTORNEYS AND AGENTS.

16. Your Account Information

In consideration of your use of the Site you agree to: (i) provide accurate and current information about yourself as prompted during phone or fax orders or by the Site (the "Registration Information"); and (ii) maintain and update the Registration Information to keep it accurate and current. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may, in our sole discretion, suspend or terminate your account, decline to fulfill your order, and decline to permit your continued use of the Site and future access to the Site.

17. Custom Imprinting and Artwork
If you have a project or team logo or graphic, we can imprint it on many of the items we sell.  Each item we sell has specific requirements for the resolution, size, colors, and file format of your artwork in order for it to be imprinted.  If your artwork doesn’t meet the requirements, we can fix it for you – often at a nominal cost.  If you order a custom imprinted item, send us your logo or other artwork to artwork@promomento.com.  We’ll let you know if it doesn’t meet the specifications for the particular item you ordered.  In general, it’s best if your artwork is 300dpi or higher and created in CorelDraw (.cdr) or Adobe Illustrator (.eps).  If you want your company’s logo imprinted on a product, ask for a ‘camera ready’ copy of your logo from your company’s Marketing Department or other department that handles your advertising.

Before we print your order, we’ll send you a proof so you can review the artwork.  We must receive your written (fax) approval of the proof before we release your order for production.  For some orders we may require you to approve a physical sample before we release your order for production.  This process may increase the turnaround time of your order, but it’s a sound risk management procedure for you and us.

18. Possible Additional Charges
Orders involving imprinting or other customization may necessitate additional charges for artwork rendering, set-up of imprinting equipment, multiple or custom colors, and production overruns.  We’ll discuss these possible costs with you when you place your order or before we release the order to production.

19.  Trademarks
By submitting your company, project or team name, slogan, logo, or artwork to us, you as the customer represent that the use or display of the words or image will not violate any copyright, trademark, or other applicable laws.  You agree to defend and hold Promomento.com, ClearLaunch Consulting LLC, its officers, employees, and agents harmless from any claim, damage, attorney’s fees and costs, or other costs in any infringement action that results from us printing the words or image.  Our website may contain artwork, designs, logos, or other trademarked items that are owned by companies other than Promomento.com and ClearLaunch Consulting LLC.  The use of these items on our site is not intended as an endorsement of Promomento.com or ClearLaunch Consulting LLC by these companies.  These images are used merely as a demonstration of the products and customization features available from Promomento.com and ClearLaunch Consulting LLC.  These products are not offered for sale.

FAQ

Why do you have to order certain items for me?

We need to place the order for you on certain items to ensure that you get the best service and the deal on price and order quantity.  For custom items with imprinted logos, we need to review your artwork in advance to ensure it meets specifications for imprinting.  If you find an item online and are not able to place the order, please contact our Sales Department so we can place the order for you.

How long will it take for my order to arrive?

Order turn-around time depends on the item ordered and whether any customization (like imprinting) was requested.  If you need an item by a certain date, please let us know so we can work with you to ensure it will be ready on time.

Can I get my project logo imprinted on a product?

Yes, we can imprint your project’s or team’s name, logo, motto, or slogan on many of our items.  See our section on Custom Imprinting for more information.

I found the item I want on your website, but it says I have to order a higher quantity than I need.  Can I buy less?

Sometimes we can sell you less than the posted minimum amount.   Let us know which item you want and we’ll work with you to try to meet your needs.

I’d like to talk with you outside of your posted business hours.  Is that possible?

Do you ship orders outside the U.S?

Some of the items we sell cannot be shipped outside of the U.S.  If you are outside the U.S., give us a call and we'll determine if we can ship your item of interest to your country.
